Mediation

We focus on pre-mediation communication to ensure an effective process. By reviewing key documents and holding pre-mediation conferences, we are better equipped to facilitate a resolution. It is essential that parties have full authority to reach a solution.

Scheduling.
To schedule a mediation or meeting, please email or call Mark directly.
Process.
After your mediation is confirmed, Mark will send you a mediation packet that includes an information sheet for essential contact details of all parties and their counsel. We also request key documents, select case materials, and a written mediation statement. About two days before the scheduled mediation, Mark will arrange a telephonic, Zoom, or in-person conference with each party to discuss the case and identify key issues for mediation.
Remote or In-person.
Mediations are generally conducted via Zoom or other videoconferencing platforms. If necessary, in-person mediations can be accommodated at a convenient location. Please note that there may be a room charge for in-person sessions.
Duration.
Mediations typically begin at 9:00 a.m. and are scheduled for a half day or full day. Half-day mediations last up to four hours, while full-day sessions can extend up to eight hours. Multi-day mediations are available for complex matters. If additional time is needed beyond the scheduled duration, an extra hourly fee may be charged to each party.

Early Neutral Evaluation

Early neutral evaluation is a non-adversarial, non-binding process that allows parties to obtain a fair and neutral assessment of their dispute. This flexible process serves as an early "preview" of a third party's perspective. Parties determine the type and amount of information to provide for the evaluation. The end product is either an oral or written evaluation discussing the strengths and weaknesses of each party's position. Parties may then choose to mediate the case with Mark or another neutral, or attempt to resolve the matter independently.
